These Terms and Conditions of Sale (the "Terms") govern the sale of products by MachNutrition Ltd ("Mach", "us", "we" or "our") through www.machnutrition.co.uk and any associated online sales channels.

2. Scope of these Terms
These Terms apply to the sale of physical products by Mach to consumers through the Website. By placing an order, you confirm that you have read and accepted these Terms.
If you are buying products in the course of a business, separate terms may apply and Mach reserves the right to refuse or cancel business orders placed through the consumer checkout.
3. Eligibility
You may only place an order if you are legally capable of entering into a binding contract under the law of England and Wales. By placing an order, you confirm that the information you provide is accurate and complete.
4. Product information
Mach aims to ensure that all product descriptions, images, packaging details, ingredient information, pricing and availability shown on the Website are accurate. However, images are for illustration purposes only, and actual packaging or appearance may vary slightly from that shown on the Website.
Products should always be used in accordance with their packaging, instructions and any safety or usage guidance provided. Nothing on the Website is intended as medical advice or as a substitute for professional advice from a qualified healthcare provider.
If you have allergies, intolerances, medical conditions, are pregnant, breastfeeding, taking medication, or have any concerns about the suitability of a product, you should read the label carefully and seek appropriate professional advice before use.
5. Orders and contract formation
The Website will guide you through the steps required to place an order. Before submitting your order, you will have the opportunity to check and amend any errors.
Placing an order constitutes an offer to buy products from Mach. An order is only accepted when Mach sends you an order confirmation email stating that the order has been accepted, at which point a binding contract is formed.
If Mach is unable to accept your order, you will be informed and no charge will be made, or any payment taken will be refunded. Mach may be unable to accept an order because a product is unavailable, payment cannot be authorised, there is an error in pricing or description, delivery restrictions apply, or fraud or misuse is suspected.
6. Prices and payment
The price of products will be as shown on the Website at the time you place your order. Prices are stated in pounds sterling and include VAT where applicable, but exclude delivery charges unless expressly stated otherwise.
Any applicable delivery charges will be shown before you complete your order. The total price, including taxes and delivery charges, will be made clear before the order is placed.
Payment must be made using one of the payment methods made available on the Website.Payment is usually taken when the order is placed, although dispatch may take place later.
If a pricing error is obvious and unmistakable and could reasonably have been recognised as amis pricing, Mach does not have to supply the product at the incorrect price. If an error is discovered after you place an order, Mach will contact you and give you the option to reconfirm the order at the correct price or cancel it.
7. Availability
All products are subject to availability. Mach may limit quantities per order, per customer, per household or per delivery address where reasonably necessary to protect stock, prevent misuse or maintain fair access to products.
8. Delivery
Mach will provide information about available delivery options, estimated delivery times and delivery charges during the checkout process.
Unless a different period is agreed with you, products must be delivered without undue delay and in any event within 30 days after the contract is entered into.
If Mach is unable to deliver within the stated or legally required period, you may have the rights provided by law, including the right to treat the contract as at an end in certain circumstances.
Delivery is completed when the products are delivered to the address you gave for delivery and the products will be your responsibility from that time. Ownership of the products passes to you when full payment has been received and the products have been delivered.
It is your responsibility to ensure that the delivery address is accurate and that someone is available to receive the order where necessary. Mach is not responsible for delays caused by events outside its reasonable control or by incorrect delivery details supplied by you.
9. International delivery
Mach may restrict delivery to certain countries or regions. If international delivery is offered, you are responsible for any customs duties, import taxes, local regulatory restrictions or other charges that apply in the destination country, unless stated otherwise on the Website.
10. Your right to cancel
If you are a consumer buying online, you generally have the legal right to cancel your contract within 14 days without giving any reason under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
The cancellation period expires 14 days after the day on which you, or a person nominated by you, receives the goods.
To exercise the right to cancel, you must inform Mach of your decision to cancel by a clear statement, for example by email. You may use a cancellation form, but you do not have to.
If you cancel, you must send the goods back within 14 days of telling Mach that you wish to cancel, unless Mach agrees to collect them.
Mach will reimburse all payments received from you for the cancelled goods, including the cost of the least expensive standard delivery option offered, without undue delay and in any event no later than 14 days after receiving the goods back or receiving evidence that you have sent them back, whichever is earlier.
Unless the goods are faulty or not as described, you are responsible for the direct cost of returning goods when you cancel under the 14-day cooling-off right, provided this has been made clear to you before purchase.
You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.[cite:151]
11. Exceptions to the right to cancel
The right to cancel may not apply, or may be lost, in relation to certain goods, including:[cite:151][cite:158]
goods made to your specifications or clearly personalised;
sealed goods which are not suitable for return for health protection or hygiene reasons, ifthey become unsealed after delivery;
goods liable to deteriorate or expire rapidly; and
any other goods excluded by law from cancellation rights.
If a product falls within one of these exceptions, this should be made clear on the Website before purchase.
12. Faulty, damaged or incorrect goods
You have legal rights under the Consumer Rights Act 2015 in relation to goods that are faulty, not as described or not fit for purpose. These rights are not affected by these Terms.
If the goods are faulty, damaged, or not as described, please contact Mach as soon as reasonably possible with details of the issue. Mach may ask for photographs, batch information or the return of the goods in order to assess the problem.
Where required by law, Mach will offer an appropriate remedy, which may include a refund, repair, replacement or price reduction depending on the circumstances and the timing of the claim.
If you validly reject faulty goods, Mach will bear the reasonable cost of return in accordance with your statutory rights.
13. Returns process
To request a return, cancellation or refund, please contact contact@machnutrition.co.uk with your order number, the products concerned and the reason for the request. The return address will be provided by email.
Mach may provide instructions for returning goods, including packaging requirements. Goods should be returned unused where possible and in their original packaging, although this does not affect your statutory right to inspect goods to the extent allowed by law.
Mach recommends obtaining proof of postage when returning goods.
14. Refunds
Refunds will be made using the same payment method used for the original transaction unless expressly agreed otherwise.
Mach may withhold a refund for cancelled goods until the goods are received back or evidence is provided that they have been sent back, whichever is earlier, where this is permitted by law.
Any refund of upgraded or express delivery charges is limited to the basic standard delivery cost where a cancellation right applies.
15. Promotions, discount codes and gift offers
From time to time, Mach may offer promotions, introductory offers, discount codes, bundles, referral offers or gift-with-purchase promotions. Unless expressly stated otherwise, promotions:
are subject to availability;
cannot be used retrospectively;
may be limited to one use per customer, household or order;
may not be combined with other offers; and
may be withdrawn, amended or suspended at any time where reasonably necessary.
Where a promotion is subject to separate terms, those terms will apply in addition to theseTerms.
16. Subscription or repeat orders
If Mach offers subscriptions, repeat-delivery plans or auto-renewing services, additional terms may apply, including the billing cycle and any pricing details. Unless stated otherwise at the point of sign-up, subscriptions can be cancelled at any time through your customer profile.

17. Intellectual property
All content on the Website, including text, graphics, branding, trade marks, logos, product names, packaging, images, website design and other materials, is owned by or licensed to Mach and is protected by intellectual property laws. No rights are granted to use any of these materials except as necessary to use the Website for personal, non-commercial purposes.
18. Website use
You must not misuse the Website, attempt to interfere with its operation, introduce malicious code, scrape data, use the Website for unlawful purposes, or infringe the rights of Mach or any third party.
Mach may suspend, restrict or terminate access to the Website where reasonably necessary for security, maintenance, legal compliance or misuse prevention.
19. Limitation of liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or for breach of your statutory rights as a consumer.
Subject to the above, Mach is not liable for losses that are not a foreseeable consequence of a breach of these Terms, losses caused by events outside Mach's reasonable control, or business losses suffered by consumers, including loss of profit, loss of business, business interruption or loss of business opportunity.
20. Product suitability and health disclaimer
Mach products are sold as consumer goods and should be used only as directed. Individual results may vary.
Statements on the Website and product packaging are not intended to diagnose, treat, cure or prevent any disease. If you have a medical condition or health concerns, you should consult a suitably qualified healthcare professional before using the products.
21. Privacy and cookies
Personal data submitted through the Website will be handled in accordance with Mach's Privacy Policy and Cookie Policy, which are available on the Website.
22. Events outside reasonable control
Mach is not responsible for delays or failure to perform obligations under these Terms where the delay or failure results from events outside its reasonable control, including strikes, transport disruption, accidents, severe weather, natural disasters, epidemics, supply chain disruption, power failure, internet failure or governmental action. If such an event occurs,Mach will take reasonable steps to minimise the impact and perform its obligations as soon as reasonably possible.
23. Changes to these Terms
Mach may amend these Terms from time to time. Any changes will apply to orders placed after the updated Terms are published on the Website. The version in force at the time of your order will apply to that order.
24. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will remain in full force and effect.
25. Third-party rights
Only you and Mach have rights under these Terms. No other person has any right to enforce any provision of these Terms, except where the law provides otherwise.
26. Governing law and jurisdiction
These Terms are governed by the law of England and Wales. If you are a consumer, you may bring legal proceedings in respect of these Terms in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts of your part of the UK.
